Terms & Conditions

These Terms & Conditions (“Terms”) govern access to and use of Peham Social(the “Service”), operated by Peham Ltd (“Peham,” “we,” “us,” or “our”) at https://socials.manage.peham.agency.
By creating an account, signing in, connecting channels, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization (a “Tenant”).
If you do not agree, do not access or use the Service.
1. The Service
Peham Social is a multi-tenant platform that helps agencies and brands plan, generate, approve, schedule, and publish content to connected social and local business channels. Features may include (depending on your plan and configuration):
- Workspace and project management for multiple brands/clients.
- Channel connections via OAuth or credentials (including Meta, X, LinkedIn, TikTok, Pinterest, WordPress, Canva, and Google Business Profile / Google My Business).
- Content drafting, media libraries, calendars, approvals, and scheduled publishing.
- Optional AI-assisted content and strategy tooling.
- Analytics syncing and operational notifications.
We may modify, suspend, or discontinue features with reasonable notice where practicable. Beta or experimental features may change or be withdrawn without prior notice.
2. Accounts and eligibility
- You must provide accurate registration information and keep credentials confidential.
- You are responsible for activity under your user account, including actions by staff you invite.
- Tenant Owners and Administrators are responsible for managing seats, roles, and access within their workspace.
- You must be legally able to enter a binding contract and use the Service for lawful business purposes.
- We may require multi-factor authentication for certain roles or environments.
3. Tenant responsibilities and acceptable use
You agree that you will not:
- Use the Service to violate any law, regulation, or third-party right (including intellectual property, privacy, and publicity rights).
- Publish spam, malware, deceptive content, harassment, or content prohibited by connected platforms.
- Attempt to bypass security, quotas, or multi-tenant isolation; probe, scrape, or overload the Service except via documented APIs you are permitted to use.
- Reverse engineer the Service except to the extent such restriction is prohibited by law.
- Misrepresent your identity or your authority to manage connected pages, profiles, or business locations.
- Resell or sublicense the Service except as expressly agreed in writing with Peham.
You are solely responsible for the content you create, schedule, and publish, and for obtaining all rights and consents needed to use that content and to manage connected accounts.
4. Third-party platforms and Google Business Profile
The Service depends on third-party platforms and APIs. Those platforms may change scopes, rate limits, policies, or availability at any time. Peham is not responsible for outages, policy enforcement, account restrictions, or API changes by third parties.
When you connect a third-party account, you:
- Authorize Peham Social to access and use that account as needed to provide the features you use (for example, listing locations, creating posts, reading delivery status, or syncing limited insights).
- Confirm you have the legal right and platform permissions to grant that access.
- Agree to comply with the third party's terms, developer policies, and community guidelines.
For Google Business Profile specifically, your use is also subject to applicable Google terms and policies. You may revoke access at any time in Google Account settings and by disconnecting the integration in the Service. Revocation or platform-side failures may prevent publishing until reconnected.
5. Content ownership and license
- Your Content.As between you and Peham, you (or your clients, as applicable) retain ownership of content you submit to the Service (“Customer Content”).
- License to Peham. You grant Peham a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and otherwise use Customer Content solely to provide, secure, and improve the Service and as otherwise directed by you.
- Feedback. If you provide feedback or suggestions, we may use them without obligation to you.
- Peham IP.The Service software, branding, UI, and documentation remain Peham's intellectual property. These Terms do not transfer ownership of Peham IP to you.
6. AI-assisted features
Where AI features are enabled, outputs may be inaccurate, incomplete, or unsuitable for publication without human review. You remain responsible for reviewing and approving content before it is scheduled or published. Do not rely on AI outputs as legal, compliance, or professional advice.
7. Confidentiality
Each party may receive confidential information from the other. Recipients must protect that information with reasonable care and use it only to perform under these Terms, except where information is public, independently developed, rightfully received from a third party, or required to be disclosed by law (with notice where legally permitted).
8. Fees and plans
Access may be provided under a commercial agreement, internal Peham use, trial, or other arrangement. If paid plans apply, fees, billing cycle, taxes, and usage limits will be set out in an order form, invoice, or separate agreement. Failure to pay may result in suspension. Unused quotas generally do not roll over unless stated otherwise.
9. Suspension and termination
You may stop using the Service at any time. Tenant Owners may request workspace closure by contacting us. We may suspend or terminate access immediately if you breach these Terms, create risk to the Service or others, fail to pay amounts due, or if required by law or a third-party platform.
Upon termination, your right to use the Service ends. We may delete or deactivate Customer Content after a reasonable wind-down period, subject to legal retention needs and our Privacy Policy. Provisions that by nature should survive (including ownership, disclaimers, limitations of liability, and indemnity) will survive termination.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEHAM DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT PUBLISHING TO THIRD-PARTY PLATFORMS WILL ALWAYS SUCCEED.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEHAM AND ITS DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEHAM'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO PEHAM FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY (OR, IF NONE, ONE HUNDRED US DOLLARS / EQUIVALENT).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.
12. Indemnity
You will defend and indemnify Peham against claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) Customer Content; (b) your use of connected third-party accounts; (c) your breach of these Terms or applicable law; or (d) disputes between you and your clients, end users, or platform providers.
13. Privacy
Our collection and use of personal information is described in the Privacy Policy. By using the Service, you acknowledge that policy.
14. Changes to the Terms
We may update these Terms by posting a revised version on this page and updating the “Last updated” date. Material changes may also be communicated in-product or by email. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and request account closure.
15. Governing law
These Terms are governed by the laws of Pakistan, without regard to conflict-of-law rules, unless a written agreement with Peham states otherwise. Courts located in Pakistan will have exclusive jurisdiction over disputes, subject to any mandatory consumer protections that cannot be waived.
16. Miscellaneous
- These Terms, the Privacy Policy, and any order form or written agreement constitute the entire agreement regarding the Service.
- If any provision is unenforceable, the remainder remains in effect.
- Failure to enforce a provision is not a waiver.
- You may not assign these Terms without our prior written consent; we may assign them in connection with a corporate reorganization or sale.
